1. Article 1 - Scope of application
    1. These terms of use apply to the use of the online customer area and the offers and services available through this area.
    2. The online customer area is available to SEY customers. The use of offers and services may depend on the category of consumer and the business relationship with the SEY. It is not possible to guarantee unlimited availability of all services, regardless of the consumer category and the business relationship.
    3. The use of the online customer area is also offered to the customers of the SEY's commercial partners who outsource the management and billing of their customers to the SEY.
  2. Article 2 - Scope of services
    1. The services available in the online customer area include: - Management of customer data - Obtaining information such as consumption data, invoices, etc. - Ordering products and services - Additional services in accordance with special contractual agreements
    2. The SEY reserves the right to change the content of the online customer area and the scope of services at any time and/or to adapt it to technical and legal conditions.
    3. In the event of a change of consumer category or business relationship, certain services may no longer be available to the customer (e.g. when moving outside the SEY service area).
    4. With the online customer area, SEY offers the user products and services that are subject to a charge (e.g. changing electricity products). To order, the user can be redirected to the page of the offer in question. The contractual conditions for the product published there apply.
    5. The SEY strives to ensure that the availability of the online customer area is as high as possible and that there are as few interruptions as possible. However, it does not guarantee that access to the online customer area, functions and services can be used without interruptions or disturbances.
    6. The SEY does not guarantee access to the platform or/and all services to all web browsers, operating systems or mobile devices. The SEY does not guarantee the access or the use of the services of the online customer area to old versions of web browsers.
  3. Article 3 - Registration
    1. Registration is done online using a web form. The information provided must be truthful. Registration is completed once a secure e-mail address and password have been set. Then an activation e-mail is sent to the specified e-mail address to authenticate the data.
    2. The SEY reserves the right to refuse an application for registration without giving reasons.
    3. The customer agrees that the SEY may in future use the e-mail address provided during registration for the online customer area for any type of correspondence (e.g. communication of changes to the TOU, presentation of offers, invoicing or communication of electricity tariffs).
  4. Article 4 - Access
    1. Access to the online customer area is gained by entering the e-mail address and a personal password.
    2. Any user logging in to the online customer area with this data is considered by the SEY to be entitled to use the online services. No further verification of identity will be required and the SEY can receive and implement orders from the identified user (who has passed the login procedure)
    3. The SEY offers the possibility of enhancing the security of the online customer area access procedure by means of two-factor authentication. The customer can activate this option at any time. If the customer wishes to remove the two-factor authentication, he/she must send a written request to the SEY at the SEY's e-mail address or by using the generic contact form.
    4. The client's declarations, whatever their nature (orders, messages, etc.), are considered as issued when their transmission to the SEY has been validated.
  5. Article 5 - Duties of care of the user
    1. The customer shall ensure that the personal access data is stored carefully and securely and is responsible for protecting it against unauthorised use (e.g. by regularly changing the password).
    2. If it is suspected that an unauthorised person has gained knowledge of the password and/or obtained the login, the password and possibly the entire login must be changed immediately. If necessary, a request to block access can be sent to the SEY.
    3. The instructions given by the SEY in the context of the use of the online customer area as well as the security instructions of the online customer area must be respected by the user of the online customer area.
  6. Article 6 - Blocking
    1. The SEY is entitled to block access to the online customer area and online services at any time without prior notice, in whole or in part.
    2. The user can demand in writing that the SEY blocks his user account at any time. The blocking shall only be terminated upon written request.
    3. Access to the online customer area is removed if the user requests this in writing to the SEY.
  7. Article 7 - Data protection
    1. The SEY complies with the provisions of Swiss data protection law when collecting and processing personal data. It protects customer data with appropriate measures and treats it confidentially.
    2. When accessing the online customer area, each access is automatically recorded in a temporary log file. For this purpose, various access data concerning the establishment and maintenance of the connection (e.g. IP address, date and time of access, name of the file accessed, browser version, operating system version) are recorded and evaluated anonymously. This data is mainly required to enable the use of our content (establishment of the connection). It is also required for internal system-related purposes, such as technical administration and system security.
    3. The SEY only collects data that is necessary for the provision of its services and for the development and maintenance of the customer relationship, in particular to ensure a high quality of service, but also for billing and for the security of the operation and infrastructure.
    4. The SEY is entitled to make use of third parties and to make the necessary data available to these third parties. The customer understands and accepts that data may also be transmitted abroad, in compliance with the applicable data protection regulations.
    5. The privacy policy (link to be inserted), as well as the general terms and conditions of each product and service, provide further information on data processing.
  8. Article 8 - Liability
    1. Each party assumes its own transmission risk and is responsible for all damages due to incorrect transmission.
    2. The SEY is not liable for any direct or indirect consequential damage caused by
      1. Misuse of the password and/or user name
      2. Unauthorised access to the online customer area
      3. Incorrect information entered by the user in the online customer area
      4. An interruption or malfunction of the online customer area
    3. Furthermore, the SEY is not responsible:
      1. The content of the Internet pages linked to the online customer area
      2. On the use of the services of Internet service providers
      3. the obsolescence of the hardware or software used by the customer to access the online customer area
  9. Article 9 - Termination of registration
    1. Either party may terminate the registration at any time
    2. The customer may request the deletion of his registration in the online customer area in writing or by e-mail to .......
    3. The termination of the business relationship with the SEY leads to the blocking of access to the online customer area.
  10.  Article 10 - Modification of the conditions of use
    1. The SEY is entitled to change the conditions of use of the online customer area at any time. Users shall be informed of the changes in an appropriate form. These are considered accepted by the user from the first use of the online customer area following the notification of the change.
  11.  Article 11 - Applicable law and jurisdiction
    1. In the event of a dispute, the current TOU shall be used as the legal basis. These TOU are governed by Swiss law, to the exclusion of all other laws.
    2. The place of jurisdiction is Yverdon-les-Bains, Switzerland. The provisions relating to the place of jurisdiction of consumers are reserved.
